I am a private employee, and has a land area of 120 m of property to be acquired by a company engaged in the field of special culinary initial premises sells Ayam Bakar grilled chicken MM. We heard the information that companies are legal entities may not buy land with the status of Ownership (SHM). If the information is true, how the alternatives to be able to sell our land to the company?
It is true that a corporation is not allowed to own land with the status of Property Rights. Thus the alternative to do is change the right of first before doing the transfer of rights (selling). In this case the Head of the Land Office will change the status of Property Rights (HM) a Right to Build (HGB) or Right to Use (HP).
The process of transfer of rights (purchase) is as follows.
A. Apply to the Chief of the Land Office
for certificates issued Broking / Right to Use of the land. Or the Parties make a Sale and Purchase Agreement and give a power of attorney to Mr. companies. Based on the authorization letter, the company can apply the right changes (from the Property into Broking / Right to Use) in the name of the Father, to the Head Office.
2. Furthermore the Land Office will issue a certificate Hak Guna.
Building / Use Rights on behalf of the owner. Broking Certificate / Right to Use is used for transfer of deed (Deed of Sale and Purchase) in the presence of PPAT to turn right and then filed the registration in the local Land Office (No. PMNA. 2 of 1993).
The process of transfer of rights (selling) on top of the steps can be taken. Please note for the process, all costs incurred to change the rights or land for sale-as-usual PPAT honorarium cost is borne entirely by the company / investors to acquire land.
The status of land use right certificates up (HGB) can be used as a certificate of ownership (SHM) by performing the maintenance of the land office in the land of SHGB located. With HGB land certificate shall be owned by citizens of Indonesia (WNI) with an area of less than 600 square meters, still control the land and have HGB that is still valid or has expired.
Terms HGB apply for a certificate to change ownership:
1. The original certificate is HGB status will be changed2. Photocopy of the IMB (building permits) which is used to set the building permit
3. Proof of identity
4. Photocopy of the UN SPPT (property tax) last
5. Letter of request to the Head of the local Land Office
6. Letter of revelation does not own the land more than 5 fields and the area less than 5000 square meters.
